GENERAL CONDITIONS OF THE GABBRO BERTH TERMINAL FACILITY
NOTICE OF ARRIVAL:
 

Each vessel Owner or Charterer expecting to berth a vessel or barge at GBT (Gabbro Berth Terminal) shall obtain suitability approval & berth booking before loading the vessel Vessel agent should give 72 hours prior notice of the arrival as per criteria. Master of vessels must contact Messaieed Port Control on VHF Channel 11 & 14 when in range. Terminal Users shall comply and adhere to the Conditions of Entry- COE of the Gabbro Berth Terminal Facility.

CARGO HANDLING RIGHTS AT THE GABBRO BERTH TERMINAL:

Terminal Operator reserves the right to control and perform the unloading and handling of all cargo.

The Consignee must ensure that there is sufficient yard capacity and the appointed transporter shall supply required trucks in order to sustain the berth efficiency level of minimum 1000 tons per hour.

Failure to comply with these KPI requirements shall give the right to Terminal Operator to remove the vessel or barge from the berth to anchorage.


VACATION OF BERTH:

Terminal Operator reserves the right to instruct a vessel to vacate its allocated berth on completion of discharge on receipt which to advise Master of Vessel on Notice of Readiness to sail within 1 hour upon completion.


CUSTOMS:

Customs Duty is payable on all cargo imported into the country in accordance with published tariff and regulations. The vessel or barge agent must ensure the availability of a customs official one hour after vessel or barge secured and one hour before last cargo move on the vessel or barge.

Berth hire will apply if no customs official is available as stated.


IMMIGRATION:

Qatar Immigration rules and regulations shall apply. Shore leave or the crews leaving the vessels or barges are not permitted. The vessel agent must engage the immigration office.


POLLUTION:
 

Environmental preservation is a top priority for QPMC. Messaieed - one of Qatar's major industrial cities is also becoming the hub for environmental initiatives. As per Qatar Standard 2% dust is allowable. Powder cargo brings in more dust and pollutes the environment, making it unsafe for working in dusty atmosphere.

Dust suppression system is fixed on all shore cranes to reduce the dust emission into air.


NON – PERFORMANCE / NON –CONFORMANCE:
 

The Operator reserves the right to perform the following actions due to non-performance/ noncompliance with operational procedures of Users:

When sufficient transportation is unavailable to meet and support the efficiency level of 1000 tons per vessel hour, Terminal Operator shall have the right to contract additional transportation at the consignee’s costs.

To replace the pre-arranged transport of the Consignees with another due to poor performance and inability to sustain the berths required efficiency level.

To remove the vessel or barge from the berth if the consignee is unable to meet the required handling rate per hour should it be found that the constraints of yard capacity and transportation.

All costs for the removal of vessel, barge will be for the consignee account.

Berth cleaning cost will be on consignee account

To arrange with the Consignee / vessel agent / operational managers the wash-up meeting if a vessel or barge with poor performance is identified.

To enforce a penalty for vessels or barges that have overstayed on the berth per LOA of vessel, barge x QR25 x hours overstayed on the berth.


GOVERNING LAW:
 

The terms and conditions shall be construed, interpreted, and applied in accordance with the laws of the State of Qatar. In the event of conflict and / or dispute, the parties shall submit exclusively to the jurisdiction of the courts of the State of Qatar.
